Terms and Conditions for Finsbury Park Rubbish Collection Services

These Terms and Conditions set out the basis on which we provide rubbish collection and related waste removal services within the Finsbury Park area and surrounding locations. By making a booking, confirming a quotation, or allowing our team to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following words have the meanings given below:

1.1 We, us, our: The rubbish collection service provider operating in and around Finsbury Park.

1.2 You, your, customer: The individual, company, or organisation requesting or receiving our rubbish collection services.

1.3 Services: Any rubbish collection, waste removal, bulky waste clearance, or associated services we agree to provide.

1.5 Waste: Any items, rubbish, refuse, or materials you ask us to collect and remove.

2. Scope of Services

2.1 We provide rubbish collection and waste removal services for domestic and commercial customers in the Finsbury Park area and nearby neighbourhoods. This may include household waste, garden waste, office clearances, bulky items, and general non-hazardous rubbish, subject to applicable regulations.

2.2 The precise scope of services, including the type and approximate volume of waste to be collected, access requirements, date and time of attendance, and quoted price, will be agreed at the time of booking based on the information you provide.

2.3 We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, prohibited, incorrectly described, unsafe to handle, or not in accordance with current waste regulations or our licence conditions.

3. Booking Process

(a) your name and contact details;

(c) a clear description of the waste, including type, estimated quantity or volume, and any special handling needs;

(d) access details and any restrictions that may affect our ability to carry out the work.

3.3 Based on the information you provide, we will issue an estimated quotation and, where possible, an appointment date and time window for our collection team.

3.4 A booking is only confirmed when we have accepted your request and provided written or verbal confirmation. We may decline a booking at our discretion, including where we reasonably believe that the waste cannot be collected safely or lawfully.

3.5 If on arrival the actual volume, type or condition of the waste differs significantly from that described at the time of booking, we may revise the quotation, adjust the service, or refuse to proceed with the collection. Any revised price will be agreed with you before work continues.

4. Pricing and Quotations

4.1 Unless otherwise stated, all prices are quoted in pounds sterling and are exclusive of VAT. Where VAT applies, it will be added at the prevailing rate.

4.2 Quotations are based on information you supply and are normally given as fixed or estimated prices. If additional labour, time, or disposal costs are incurred due to inaccurate information, access issues, or extra waste being presented, we may vary the price accordingly.

4.3 Any waiting time, delays caused by inadequate access, or failure to segregate waste where agreed may result in additional charges. We will inform you of such charges wherever reasonably practicable before proceeding.

4.4 Quotations are valid for a limited period, which will be specified at the time of issue. We reserve the right to revise or withdraw a quotation if it is not accepted within that period.

5. Payments

5.1 Payment terms will be agreed at the time of booking. Unless otherwise agreed in writing, payment is due immediately upon completion of the collection, or in advance for certain services.

5.2 We accept payment by the methods notified to you at the time of booking, which may include card payment, bank transfer, or cash to the driver. Certain payment methods may not be available for all bookings.

5.3 If payment is not made on the due date, we may charge interest on outstanding amounts at the statutory rate applicable to commercial debts or, in the case of consumer customers, at a reasonable rate reflecting our administrative costs.

5.4 Where services are provided on account or credit terms, invoices must be settled within the agreed period. We may suspend further services if invoices remain unpaid or if credit limits are exceeded.

6. Cancellations and Amendments

6.1 You may cancel or amend a booking by contacting us using the details provided in your booking confirmation.

6.2 For most domestic rubbish collection bookings, you may cancel free of charge up to 24 hours before the scheduled collection time. Cancellations made within 24 hours may be subject to a reasonable cancellation fee to cover administrative and scheduling costs.

6.3 For larger commercial or multi-load collections, different cancellation terms may apply, and these will be communicated to you at the time of booking. We may request a deposit, which may be non-refundable if you cancel at short notice.

6.4 If we arrive at the property and are unable to carry out the collection because you are not present (where your presence is required), access is not available, or the waste differs materially from that described, we may charge a call-out or wasted journey fee.

6.5 We reserve the right to cancel or reschedule a booking due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents, or changes in legal or regulatory requirements. In such cases, we will notify you as soon as reasonably practicable and arrange a new collection date.

7. Customer Responsibilities

7.1 You are responsible for ensuring that:

(a) you have full authority to request the removal of waste from the property;

(b) access to the property is safe, unobstructed, and suitable for our collection team and vehicle;

(c) the waste is clearly identified, accessible, and not mixed with hazardous or prohibited materials;

(d) any required permits, consents, or authorisations, such as access through shared areas or parking permissions, are in place.

7.2 You must inform us in advance of any potential risks at the property, including uneven surfaces, restricted access, security features, aggressive animals, or any other hazards that may affect the safe delivery of our services.

7.3 You must not include in the waste any items that are classified as hazardous or controlled without prior written agreement. This may include, but is not limited to, asbestos, chemicals, solvents, oils, gas cylinders, clinical waste, electrical equipment requiring special treatment, or any other specialist waste requiring licensed disposal.

8. Waste Regulations and Environmental Compliance

8.1 We operate in accordance with applicable UK waste management and environmental legislation. Our objective is to ensure that waste collected from the Finsbury Park area is handled, transported, and disposed of in a lawful and responsible manner.

8.2 We will transport your waste only to authorised disposal, treatment, or recycling facilities and will use reasonable efforts to maximise recycling and recovery in line with current best practice and regulatory requirements.

8.3 By using our services, you confirm that you have a legal duty of care in respect of your waste and will cooperate with us to ensure full compliance with relevant waste regulations. This may include providing accurate information about the origin, type, and composition of the waste.

9. Liability and Insurance

9.1 We will exercise reasonable skill and care in the provision of our rubbish collection services. However, our liability to you is limited as set out in this section.

9.2 We hold appropriate insurance cover for our activities, including public liability insurance. Details of our insurance cover are available on request.

9.3 We will not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or loss of reputation, arising out of or in connection with the provision of our services.

9.4 Our total liability for direct loss or damage to your property caused by our negligence or breach of contract shall not exceed the amount of the fee you have paid for the specific service giving rise to the claim, except where liability cannot lawfully be limited under applicable law.

9.5 We will not be responsible for damage caused by pre-existing structural defects, poor construction, or weaknesses in buildings, driveways, access routes, or surfaces. This includes damage arising from the weight or movement of vehicles or equipment required to carry out the collection where you have requested or permitted access.

9.6 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

10. Access, Parking and Permits

10.1 You are responsible for providing suitable access and, where necessary, arranging any parking permits or temporary suspensions required for our vehicle to attend and carry out the rubbish collection safely and legally.

10.2 Parking fees, fines, or penalty charge notices incurred due to inaccurate information or your failure to arrange required permissions may be charged to you, provided that we have acted reasonably and in accordance with your instructions.

10.3 If our team reasonably considers that access is unsafe or that there is a risk of significant damage to property, we may refuse to proceed or may limit the service to what can safely be achieved. Any partial service may still be chargeable.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of our rubbish collection service, you should notify us as soon as possible, providing details of the issue, the date of the collection, and any supporting information.

11.2 We will investigate complaints promptly and aim to provide a response within a reasonable timeframe. Where appropriate, we may offer a remedy such as revisiting the property, rectifying an omission, or issuing a partial refund or credit.

11.3 Where a dispute cannot be resolved informally, either party may pursue its legal rights in accordance with the governing law and jurisdiction provisions in these Terms and Conditions.

12. Data Protection and Privacy

12.1 We collect and process personal data as necessary to manage bookings, provide services, handle payments, and comply with our legal obligations.

12.2 Your details will be handled in accordance with applicable UK data protection legislation. We will take reasonable steps to keep your information secure and will not sell your personal data to third parties.

12.3 We may share your data with trusted third parties who assist us in delivering services, such as payment processors or waste disposal partners, but only to the extent necessary for the performance of our contract with you or as required by law.

13. Variation of Terms

13.2 The version of the Terms and Conditions in force at the time you make your booking will apply to that specific service, unless a change is required by law or regulation.

14. Severability

14.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the provision of our rubbish collection services in the Finsbury Park area, or any related agreement.
